Rental Conditions of Snow & Bike Factory Willingen
1. General
- The rental item is provided in the condition in which you inspected and selected it. By doing so, you confirm that it meets the contractual requirements.
- The minimum age for concluding a rental agreement is 18 years.
- The contract can only be concluded upon presentation of a valid identity card, ID card, or passport.
- The rental item is intended exclusively for private use. Depending on the agreement, it includes a bicycle, a pair of skis, a snowboard, or a sled, including protective equipment (helmet/protectors).
2. Obligations of the Lessor
- We hand over the rental item in a safe and clean condition.
- Should maintenance or repair measures become necessary that are at our expense, you must grant us immediate access. During this time, no rental fee is charged, and the rental period is extended accordingly. Your right to extraordinary termination for good cause remains unaffected.
3. Obligations of the Lessee
- Insurance: You may take out optional insurance with us to cover breakage and damage to the rental item.
- For snowboards, skis, or sleds: €3 extra.
- For all bicycles/scooters (except freeride bikes and downhill bikes): €5 extra.
- For freeride and downhill bikes: €10 extra.
All damage that may occur during normal use is covered by this insurance. Damage caused by vandalism or theft of the rental item is not included. This insurance is voluntary. If you decline it, please inform the cashier; otherwise, it will be charged automatically. If the insurance is declined, any self-caused damage will be billed to you. The damage incurred must be paid for immediately on site.
- The rental item may be used exclusively by you personally. Transfer to third parties—including family members or partners—is not permitted.
- Treat the rental item with care and reasonable caution. Use for competitions, high-risk maneuvers, or unconventional purposes is prohibited.
- If you become aware of defects, malfunctions, or damage to the rental item or protective equipment, you must report this to us immediately. Failure to comply with this reporting obligation requires you to compensate for the resulting damage.
- The use of bicycles, skis, or snowboards requires wearing an appropriate helmet. Failure to do so and resulting injuries will result in shared liability on your part, even if we would otherwise be liable.
4. Liability of the Lessor
We are liable only in cases of gross negligence or intent on our part or on the part of our representatives. In the case of injury to life, body, or health, liability also extends to slight negligence.
5. Liability of the Lessee
You are liable for all damage caused by your fault or that of your agents—whether to the rental item, helmet, protectors, or to third parties. In the event of total loss (including theft), you must reimburse the replacement value. In the case of partial damage, you bear the cost of professional repairs (gross if carried out by us, net otherwise). Alternatively, you may arrange the repair yourself at a qualified workshop and provide proof.
6. Return of the Rental Item
- At the end of the rental period, you must return the item at your own expense to the agreed location during our opening hours.
- The return is considered in accordance with the contract if the item is cleaned and all necessary maintenance or repair work (insofar as at your expense) has been completed. Otherwise, we will request that you remedy this within a reasonable, specifically stated period. If you fail to do so, we may restore the condition ourselves and charge you for the costs.
- In the case of self-caused damage, we are not obligated to pick up the lessee.
7. Extension of the Rental Period
An extension is only possible with our prior written consent. You have no automatic right to an extension; we may decline without giving reasons.
8. Cancellation Conditions
- For individuals: Free cancellation up to 24 hours before the booked appointment. After that, the full price will be charged.
- For groups of six or more people: Free cancellation up to three days before the booked appointment. After that, the full price will be charged.
9. Miscellaneous
- Any changes or additions to the contract must be made in writing.
- Should any provision be invalid or should a gap exist in the contract, the validity of the remaining provisions shall remain unaffected.
